Terms of Service for BodySherpa

1. Acceptance of Terms

By accessing or using the BodySherpa Telegram bot ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not use our Service.

2. Description of Service

BodySherpa provides macronutrient and calorie goal-based nutrition coaching and meal logging services through a Telegram bot interface. The Service is not intended to provide medical advice.

3. Eligibility

You must be at least 13 years old to use this Service. By using the Service, you represent and warrant that you meet this eligibility requirement.

4. User Accounts

4.1 You are responsible for maintaining the confidentiality of your Telegram account and for all activities that occur under your account.

4.2 You agree to immediately notify us of any unauthorized use of your account or any other breach of security.

5. Service Tiers and Payments

5.1 BodySherpa offers both free and paid services. Users may calculate their nutrition goals for free.

5.2 Meal logging and weekly analysis and adjustments are provided free for one week, after which they become paid premium features.

5.3 By subscribing to our premium service, you agree to pay all fees associated with the plan you choose. For current pricing details, please use the /subscribe command within the Telegram bot.

5.4 Subscriptions may be canceled at any time, but we do not offer pro-rated refunds for unused time on your subscription.

5.5 We conduct business wherever our payment provider, Stripe, operates.

6. Termination

6.1 You may terminate your use of the Service at any time by unsubscribing from the premium service and deleting the Telegram chat bot.

6.2 We reserve the right to terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

7. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of BodySherpa and its licensors.

8. User Content

You are free to share screenshots and discuss the product. However, you agree not to use the Service to transmit any content that is unlawful, offensive, or otherwise objectionable.

9. Privacy Policy

10. Disclaimer

10.1 The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free.

10.2 BodySherpa is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition.

11. Limitation of Liability

In no event shall BodySherpa, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.

12. Indemnification

You agree to defend, indemnify and hold harmless BodySherpa and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, or b) a breach of these Terms.

13. Dispute Resolution

13.1 If you have any concerns or disputes about the Service, you agree to first try to resolve the dispute informally by contacting us.

13.2 If a dispute is not resolved within 30 days of submission, you and BodySherpa agree to resolve the dispute through binding arbitration, except as provided herein. Arbitration shall be conducted in the United States of America in accordance with the rules of [American Arbitration Association].

13.3 You and BodySherpa agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

14. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days' notice prior to any new terms taking effect.

15. Governing Law
